Welcome to Hey Hola Spanish the best Spanish school on line. We will refer this tutoring service as “HHS” and“we”in the following document. This document explains the terms and conditions specified by HHS to allow students use our services, including HHS calendar, Skype lessons and our exclusively designed teaching material. In order to benefit from our services you must read, comprehend and agree to establish a contract with us accepting our terms and condition and the permission to collect your personal information specified in our Privacy Policy. We will refer as “students” to all persons interested in our digital tutoring services.  This contract is addressed to our students and potential students. They become students from the moment they decide to sign up for a trial lesson through the site. Terms and conditions for the use of HHS online Spanish school are set out below.

HHS has the right to modify this terms and conditions and any policies related to our services or website. We are able to update and make changes to our website, software and services.

1. Provision of the Service.

In order to use our tutoring services you must agree to the terms and conditions and all applicable national and international regulations. Even though we offer lessons to kids and teenagers from 7-18 years old, only parents or legal guardians are enabled to book a trial or a regular lesson. The students rights are individual and not transferable. HHS reserves the right to end or prohibit the use of our tutoring services to students showing abusive or inappropriate behavior.

HHS gives access to an online platform to learn and improve Spanish where students and tutors establish a learning relationship in order to achieve linguistic goals. The Services provided by HHS are as following:

Platform Services. We are the first school with a specialized profesional team of tutors recruited in person. Our tutors know each other in real life and collaborate to develop the material and techniques to teach Spanish. HHS offers profesional tutoring services to students of all levels and nationalities. All of our tutors received a professional teaching training to teach following the HHS teaching method and materials. Students are able to choose a tutor from our team by checking their profiles and having a trial with them. Reservations for our lessons can be made by our students on the page using our calendar software. HHS provides a trustable and effective venue for all members to work together.

Payment Services. HHS provides Payment Services to buy lessons through the website. In order to start Spanish lessons, students must acquire credit lessons to book a lesson via HHS calendar. Each credit can be exchange on our calendar to book a lesson. HHS provides salary to all teachers on the first 5 days of the month. We are able to provide assistance with special situations, meaning disputes between members. The payment service do not provide internet connection services for the lessons.

2. Payment Fees & Refunds.

Students can buy lessons via PayPal using US dollars. Lessons credits expire after 365 days. Students must use their credits in the booking platform before the expire date. Additional charges, fees, taxes or interest may be charged by the students bank or credit/debit card company and they must be absorbed by student. The cost of internet connection is not included in our rates.

3. Booking Policies & Resolving Disputes.

We have a 24 hours in advance policy to cancel or reschedule a lesson. It is possible to reschedule or cancel a lesson only ifthe student makes changes before this period of time expires. To do so the student is able to manage rescheduling or cancellation through the booking site. Teachers and HHS team are able to assist students with this changes. The booking platform with no allow students to change appointments without 24 hours in advance. After this period of time the student does not have the right to reschedule or demand a new appointment, the credit will be applied and the lesson payed to the tutor. Tutors are protected by this policy in order to protect their income. Although this policy applies to all situations and modalities teachers might agree to reschedule or return the credit.

In case the student misses the lesson, the credit will be taken and there will be no possibility to reschedule or recover the session. The student is fully responsible for changes on their appointments, if lessons are scheduled during holidays or special occasions the 24 hour policy will be applied. If the student thinks its possible to be late for the lesson or its planning to do so, they must notify in advance their tutors, to wait for them. WE HAVE A 20 MINUTE TOLERANCE POLICY for class delays. After this period of time tutor will be able to leave the chatroom, lesson will be charged an credit will be lost.

HHS will be able to use the digital records of communications (e-mail and skype) to intervene in case a problematic situation or misunderstanding takes place between members of HHS community. HHS will analyze each situation in particular and determine a solution to the problem. This solutions might include transfer credits, offer refunds or reverse a bank transaction. HHS will have the right to decide which member will absorb the expenses in case these are necessary to resolve the dispute.

4. Students rights and responsibilities 

  • Have 1 free 30 minutes trial lesson with the tutor that best suits the students’ preferences.
  • Full access to Hey Hola Spanish exclusively material (E-book and infographics)
  • Access to the Rewards Program (only for beginners)
  • Possibility of paying less for the lessons if you successfully pass the e-book exam
  • Access to the HHS calendar to book lessons
  • Access to Hey Hola Spanish special customer service
  • Switch teachers for academic or personal reasons

Responsibilities 

  • Being online and ready for each class.
  • Respect day and time of class and update the information on their online calendar (you can add the appointment using the booking email confirmation)
  • Filling out the formats for each lesson or package.
  • Respect the 24 hours policy to reschedule or to cancel and the 20 minutes policy tolerance policy for class delays.

5. Teachers responsibilities 

  • Give 1 trial lesson to potential students
  • Planning and teaching the 60 minute Skype language classes according to the study plan and modality
  • Being online and ready for each class 5 minutes before the scheduled class time.
  • Update their HHS calendar
  • If the teacher is not going to be available for the time and a day established for a lesson, they must contact the student to arrange a new appointment. If the teacher cancels or reschedule without 24 hours in advance the HHS policy will not be applied. The student will be able to make free changes to the appointment. If the tutor does not show up for the lesson without previous notice the credit will be returned and teacher will have to give an extra free lesson to compensate this situation.
  • Create and design additional material to the HHS material that may be useful and helpful to the student.
  • In case the student asks for a specific topic of conversation or a grammatical theme to review, the tutor must prepare and design the class for this request.

6. Rewards program

The Rewards program is exclusively designed for novices and beginners. Your tutor will determine from the trial lesson if you are a candidate to benefit from this program. Students without any prior knowledge or with a minimum of prior knowledge are welcome to join this rewards program.

After choosing a tutor and enrolling in the Spanish standard lessons, you will begin to study Hey Hola Spanish e-book 1. You must complete the ten units of the book to request the reward. Each unit has a final test that you must pass with at least 15 points of 20.

Once you have completed the book and successfully passed all ten tests in the unit, your tutor will approve your application and send a request to take the rewards exam. The exam will be applied by the CEO of HHS, if the student passes successfully there will be a reduction of one dollar in the Spanish Standard lessons.

We have a e-book of Hey Hola Spanish for each level, every time you complete a book and pass the rewards exam a dollar will be discounted from your usual rate.

7. Managing Your Profile Information and linguistic motivation 

Students are responsible to provide updated personal data and payment details. By accepting our Terms and conditions, you hereby release HHS from any claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, which arise due to inaccurate personal information being collected and held by HHS. By accepting our terms and conditions you accept to manage your credits and information individually.

8. Technical Requirements

The minimum necessary requirements to enjoy our tutoring services are a fast and reliable internet connection and an updated software of Skype. It is necessary to install, update and perform the audio and video test provided by Skype before starting the session. If necessary, the student can ask for help from the HHS team to test the effectiveness of the video call before the session.

It is the responsibility of the student to have these technical requirements for each and every one of the sessions scheduled via our calendar. If the class is delayed for these reasons it will not be possible to recover the lost time. Similarly, if the student does not meet these requirements and technical problems causing the disruption of the lesson, the responsibility will rely on the student and the class will be charged. On the other hand, if the technical problems come from the tutor, the student will have the right to reschedule the entire session.

9. Free Trial Session.

Potential Students have the right to take a 30 minute “Free Trial Session”. The trial session is limited to one session per student. After the session and if the student is satisfied with his tutor, he/she can buy a lesson or a package of lessons from our website.

10. Controlling Law and Jurisdiction.

These Terms are governed in all respects by the laws of Mexico. However, some countries have laws that require agreements to be governed by the local laws of the consumer’s country. This paragraph doesn’t override those laws. You agree that any claim or dispute you may have against HHS must be resolved by a Mexican legal authority.

11. Arbitration.

HHS has the responsibility to intervene in possible disputes that may exist between tutors and students. We will always try to solve the problems in a reasonable and peaceful way with an ideal solution for all parties. That’s why we want to solve any problem without reaching a formal legal issue. By agreeing to our terms and conditions, the student agrees to contact the HHS team before making a formal complaint to the legal authorities.

If not resolved internally, students and HHS agree that any judicial or legal process to resolve claims related to the terms specified in this document or the services provided by the company will be presented in the courts of Mexico. Students and HHS give consent to local and personal jurisdiction in Mexican courts.

12. Limitation of Liability.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HHS, ITS AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OF OUR SERVICES AND SERVICE CONTENT. UNDER NO CIRCUMSTANCES WILL HHS BE RESPONSIBLE FOR ANY DAMAGE, LOSS OR INJURY RESULTING FROM HACKING, TAMPERING OR OTHER UNAUTHORIZED ACCESS OR USE OF THE SERVICE OR YOUR ACCOUNT OR THE INFORMATION CONTAINED THEREIN.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HHS ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT; (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO OR USE OF OUR SERVICE; (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION STORED THEREIN; (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE; (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE BY ANY THIRD PARTY; (VI) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICE; AND/OR (VII) USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY. UNDER NO CIRCUMSTANCES WILL THE TOTAL LIABILITY OF US AND OUR SUPPLIERS AND LICENSORS OF ALL KINDS ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES AND SERVICE CONTENT (INCLUDING BUT NOT LIMITED TO WARRANTY CLAIMS), REGARDLESS OF THE FORUM AND REGARDLESS OF WHETHER ANY ACTION OR CLAIM IS BASED ON CONTRACT, TORT, OR OTHERWISE, EXCEED THE AMOUNTS, IF ANY, THAT YOU HAVE PAID TO US FOR YOUR USE OF THE SERVICES AND SERVICE CONTENT. SOME JURISDICTIONS DO NOT ALLOW FOR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

13. Indemnification.

Students agreeing to the terms and conditions agree to defend and hold harmless HHS from any fault, claims, costs or damages arising from the use of the website or its breach of this Agreement and any of the Terms established.

14. Intellectual Property Rights.

HHS is a school that provides exclusive material designed by the CEO and the tutors of the company. This material is protected by copyright and is exclusive for the use of tutors and students of HHS. All the original material produced by HHS including e-books, infographics, articles, images, videos and audiovisual material as well as social media content remain at all time the sole property of HHS. HHS materials are protected under international copyright, trademark and other intellectual property laws.

15. Notices.

When completing the request form for the trial lesson students enter the personal information necessary to enjoy the tutoring services. By performing this procedure, students give permission to HHS to establish a communication via e-mail for the purpose of providing private lesson services. HHS will have permission to send students updated information about our tutoring services, offers and special material addressed to our student community.
